Johnson & Johnson, the manufacturer of the DePuy hip implant, will reportedly pay upwards of $4 billion to settle more than 7,500 lawsuits that have been filed against the company in state and federal courts. While this settlement offer has not officially been announced, with reports of this massive settlement being leaked by individuals connected with the deal, the formal announcement is expected to take place sometime next week in a federal court in Toledo, Ohio.

Upon the formal announcement, a federal judge will have to approve the deal, and at least 94 percent of the plaintiffs in these cases will have to agree to the settlement – otherwise, Johnson & Johnson could pull the offer from the table. If the settlement offer is pulled, then all of the cases would likely proceed to trial (unless another deal is struck prior to trial).

According to sources, who have opted to remain anonymous given that the formal announcement has yet to take place, the plaintiffs in these lawsuits who agree to the settlement will receive, on average, about $300,000 to compensate them for the costs of replacement surgeries and other treatments necessary to deal with the DePuy hip implant failures. The specific DePuy settlement that will be awarded to each plaintiff will depend on the extent and severity of his or her injuries.

In 2010, Johnson & Johnson officially recalled its DePuy hip replacement systems due to an exceeding number of reports regarding the fact that these devices would fail within five years of implantation. In the U.S., this recall affected approximately 37,000 individuals.
