Insurance companies deny and delay valid claims for benefits in order to save money and increase profits. However, a health insurance policy is a binding contract. If your insurer fails to provide the benefits outlined in the policy, the company can be held liable in civil court not only for the cost of the denied benefits, but also for other damages caused by their actions, including your emotional damage.
A Legal Authority on Insurance Bad Faith in Arizona
I appeared as amicus curiae (friend of the court) in the case of Zilisch v. State Farm Mutual Automobile Ins. Co., 196 Ariz. 234 (2000), in which the Arizona Supreme Court explained what is required by the duty of good faith. I was the principal author of the jury instructions used in all bad faith cases in Arizona, and have lectured extensively on the law of bad faith and the intricacies of trying a bad faith case. I also chaired the insurance bad faith litigation group for the American Association of Justice.
I represent clients in Phoenix, Scottsdale, Tempe, and throughout Maricopa County, Arizona.
