14 Nov Guilty Verdict in DUI Case Could Lead to Car Accident Lawsuit
A former Indianapolis police officer has recently been found guilty of drunk driving, which resulted in a fatal car accident. While this man – David Bisard – will likely face incarceration (as he has been found guilty of DUI, reckless homicide and criminal homicide), he could also soon be named as the defendant in a car accident lawsuit if the family of the deceased motorist chooses to hold the man liable in civil court.
According to police reports and court documents, Bisard had been driving with a blood alcohol content that was more than double the legal limit (i.e., greater than 0.16) when he hit and killed 30-year-old Eric Wells who had been riding his motorcycle at the time. Two other individuals, who were also seriously injured in this accident, reportedly survived the fatal collision.
While emergency medical responders attempted to treat Wells at the scene and quickly transported him to a local hospital, Wells ultimately died from his life-threatening injuries. Despite the fact that the defense had tried to argue that the blood sample in this case had not been properly handled and that witnesses did not see signs of intoxication in Bisard prior to the accident, the jury overseeing this case ultimately handed down a guilty verdict after having deliberated for approximately 7 hours.
Compensation for DUI Victims
Families who have lost a loved one to a fatal car accident caused by a drunk driver will likely be entitled to compensation for their losses. Although no amount of money will ever bring back a deceased loved one or be sufficient to compensate these families for such a profound loss, following through with a car accident and wrongful death lawsuit can help provide these grieving families with the compensation they need to financially get through such difficult and trying times.
