J&J Settles Ethicon Vaginal Mesh Injury Lawsuit Mid-Trial

In what seems to be a shocking reverse in Johnson & Johnson’s (J&J) strategy in the ongoing controversial mesh injury litigation, J&J has reportedly settled an Ethicon vaginal mesh injury lawsuit after the fifth day of trial.

Although the details of the settlement have not been disclosed, they could mark a growing willingness on the part of J&J to start resolving more of these cases prior to trial. In fact, some suspect that the recent $5.7 million vaginal mesh verdict that J&J was ordered to pay by a California jury may have had a lot to do with the settlement in this case (Dianne M. Bellew v. Ethicon Inc., Case No. 2:13-cv-22473).

According to court documents associated with this case, the plaintiff had an Ethicon vaginal mesh device implanted to treat her stress urinary incontinence. Within weeks of implantation, however, the plaintiff reportedly started to experience extremely painful complications. Ultimately, she had to undergo four complicated, invasive and very expensive revision surgeries to, first, remove the Ethicon implant and, then, to try to repair the extensive damage caused by that implant.

While the implant has since been removed, the plaintiffs still reportedly lives with chronic pain and some other irreversible injuries.

The Big Picture: Will a Global J&J Mesh Injury Settlement Be Coming Soon?

J&J has been vocal and vigorous about defending itself in many vaginal mesh cases that have proceeded through trial to date; in fact, fighting even after verdicts have been issued, J&J has asserted its position many times (through its spokespeople) that it plans on appealing its losses.

As a result, the move to settle a vaginal mesh injury lawsuit during trial may mark an important shift in the manufacturer’s legal strategy with these cases.
