Judge Approves $900M NFL Concussion Lawsuit Settlement

This past Wednesday, U.S. District Court Judge Anita Brody approved a massive NFL concussion settlement, noting in her 132-page ruling that the more than $900 million settlement is “fair, reasonable and adequate.”

This remarkable ruling has been handed down about 3.5 years after the first of NFL concussion lawsuits were filed. Currently, there are more than 200 NFL concussion lawsuits included in the multidistrict litigation (MDL) pending in the Eastern District of Pennsylvania. These cases have been filed on behalf of more than 5,000 retired NFL players.

According to the terms of the settlement:

  • Payouts will include compensation for retired NFL players who have been diagnosed with specific neurological conditions. Additionally, there will be monetary awards to fund programs that will diagnose, monitor and counsel the impacted individuals, as well as compensation for these individuals’ attorneys’ fees.
  • The NFL will not admit fault. Additionally, this settlement will not overturn or impact any prior legal precedents that have been set in the NFL’s favor in these types of cases.
  • Payments could be made within the next 90 to 120 days, barring the filing of any appeals (or other motions that would delay the roll out of this settlement agreement).
  • To qualify for compensation, ex-NFL players must show that their neurological injuries were related to and/or stemmed from playing NFL football.

Commenting on this settlement, NFL Executive VP and General Counsel Jeff Pash remarked:

As a result of the settlement, retirees and their families will be eligible for prompt and substantial benefits and will avoid years of costly litigation that — as Judge Brody’s comprehensive opinion makes clear — would have an uncertain prospect of success. … We look forward to implementing the terms of the settlement and continuing to work with our players, coaches and medical staffs to enhance the safety and benefits of football.
